Terms of Service

These Terms of Service govern your use of the website located at https://kastkart.com, the Kastkart Shopper App (available on iOS and Android), and the Kastkart Seller Dashboard (portal.kastkart.com), all products of Prettli Inc., operating under the trade name Kastkart (“we”, “our”, “us”). Collectively, these are referred to as the “Platform.”

By accessing or using the Platform, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing the Platform or any other services provided by Prettli Inc., DBA Kastkart.

We reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication. Your continued use of the Platform following any changes constitutes your acceptance of the updated Terms.

Platform Role and Transactions

Kastkart is a shoppable video discovery platform. Kastkart does not sell products, process payments, fulfill orders, or handle returns of any kind.

All transactions occur directly between users and sellers outside of the Kastkart Platform. Kastkart is not responsible for the accuracy of product listings, pricing, availability, payment processing, delivery, disputes, or refunds. No in-app purchases for physical goods exist on the Platform.

Kastkart is a discovery and connection platform — not a marketplace or retailer. Users who choose to purchase products from sellers do so entirely at their own discretion and outside of Kastkart.

User Accounts

To access certain features of the Platform, you may be required to create an account. You must be at least 13 years of age to create an account or use the Platform. By registering, you confirm that you meet this minimum age requirement. The following actions require a registered account:

Flagging a video or seller account for review
Contacting a seller through the Platform
Saving videos to a personal library
Subscribing to receive notifications from a specific seller

You agree to provide accurate, current, and complete information when creating your account, and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Multi-factor authentication (MFA) is available optionally to enhance your account security. If you choose to enable MFA, a phone number will be collected solely for that purpose and will not be used for marketing or any other communication.

If you believe your account has been compromised, you must notify us immediately at legal@kastkart.com.

User Interactions

The Platform enables the following interactions between users and sellers:

Browsing and watching shoppable video content
Following seller accounts
Saving videos to a personal library (account required)
Contacting sellers through the Platform (account required)
Subscribing to receive notifications from a seller (account required)
Flagging videos or seller accounts for review (account required)

All interactions with sellers or their content are at the user’s own discretion. Kastkart does not facilitate, mediate, or take responsibility for the outcome of any user-seller interaction.

Seller Content and Responsibility

Sellers are solely responsible for:

The accuracy of all product information, including names, descriptions, pricing, and availability
All video content, images, audio, and other materials they upload to the Platform
Fulfillment of orders, customer support, and refunds for any purchases made outside the Platform
Compliance with all applicable laws and regulations regarding their products and business practices

Kastkart reviews video content before allowing it to be published as shoppable content. This review screens for illegal, harmful, sexual, and violent material. However, Kastkart cannot guarantee that all non-compliant content will be identified before publication. Kastkart does not verify or guarantee the accuracy of any seller content.

Users may report content or seller accounts that they believe violate these Terms using the reporting tools available within the Platform.

Content Moderation and Reporting

Kastkart will review reports of content or accounts submitted by users and may, at its sole discretion:

Remove content that violates these Terms
Issue warnings to the account responsible
Temporarily suspend access to the Platform
Permanently terminate an account

Kastkart reserves the right to take any of the above actions without prior notice where it determines a violation has occurred or where continued access poses a risk to users or the integrity of the Platform.

Limitations of Use

By using the Platform, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on the Platform;
remove any copyright or other proprietary notations from any materials and software on the Platform;
transfer the materials to another person or “mirror” the materials on any other server;
knowingly or negligently use the Platform or any of its associated services in a way that abuses or disrupts our networks or any other service Prettli Inc., DBA Kastkart provides;
use the Platform or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
use the Platform or its associated services in violation of any applicable laws or regulations;
use the Platform in conjunction with sending unauthorized advertising or spam;
harvest, collect, or gather user data without the user’s consent; or
use the Platform or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Sellers have additional content and legal compliance obligations set out in the Seller Content and Responsibility section above.

Platform Immunity

Kastkart is an interactive computer service as defined under Section 230 of the Communications Decency Act, 47 U.S.C. § 230. Kastkart is not the publisher or speaker of any content provided by sellers or other third parties on the Platform. Kastkart is not liable for content posted, uploaded, or transmitted by sellers or users. Sellers are solely responsible for the content they publish, including its accuracy, legality, and compliance with applicable laws and third-party rights.

Intellectual Property

The intellectual property in the materials contained on the Platform are owned by or licensed to Prettli Inc., DBA Kastkart and are protected by applicable copyright and trademark law. We grant users permission to access the Platform for personal, non-commercial use only.

Kastkart owns all Platform design, branding, and functionality. Nothing in these Terms transfers any ownership of Kastkart’s intellectual property to you.

User-Generated Content

You retain ownership of all content you submit to the Platform. We will never claim ownership of your content, but we do require a license from you in order to display it.

When you upload, share, or otherwise transmit content through the Platform, you grant Prettli Inc., DBA Kastkart a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, display, distribute, and run your content in a manner consistent with the operation of the Platform and our Privacy Policy.

This license can be terminated at any time by deleting your content or closing your account, subject to any existing uses that cannot be immediately reversed.

Analytics and Data

Kastkart collects interaction data from users, including video views, product taps, direction requests to physical store locations, and visits to external seller websites. This data is used to improve the Platform and to provide sellers with performance insights.

Sellers receive only aggregated, non-identifiable performance data. No personally identifiable user information is shared with sellers under any circumstance.

Liability

The Platform and its materials are provided on an ‘as is’ basis. To the extent permitted by law, Prettli Inc., DBA Kastkart makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

In addition, Kastkart makes no representations or warranties regarding the accuracy, completeness, or legality of any content published by sellers on the Platform. Sellers are solely responsible for the accuracy and legality of their content.

In no event shall Prettli Inc., DBA Kastkart or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use the Platform, even if Prettli Inc., DBA Kastkart or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

“Consequential loss” in this agreement includes any indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties or liability for consequential or incidental damages, these limitations may not apply to you.

Accuracy of Materials

The materials appearing on the Platform are not comprehensive and are for general information purposes only. Prettli Inc., DBA Kastkart does not warrant or make any representations concerning the accuracy, likely results, or reliability of the materials on the Platform, or on any resources linked from the Platform.

Links

Prettli Inc., DBA Kastkart has not reviewed all sites linked to or accessible from the Platform and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by Prettli Inc., DBA Kastkart. Use of any linked site is at your own risk.

Right to Terminate

We may suspend or terminate your right to use the Platform and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of the Platform shall be resolved through binding arbitration conducted in the State of Delaware, in accordance with applicable arbitration rules. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, USA. You irrevocably submit to the exclusive jurisdiction of the courts in that State.

Copyright and DMCA

Kastkart respects intellectual property rights and expects sellers to do the same. Sellers are solely responsible for ensuring they own or have obtained all necessary rights and licenses to content they upload to the Platform, including video footage, images, audio, and music. Sellers may not upload content containing copyrighted music, footage, or other material without appropriate rights or licenses.

Designated DMCA Agent:

Pursuant to 17 U.S.C. § 512(c)(2), Kastkart has designated the following agent to receive notifications of claimed copyright infringement:

Notice of Claimed Infringement:

To submit a DMCA takedown notice, send a written communication to the designated agent containing:

Identification of the copyrighted work claimed to have been infringed
Identification of the infringing material and its location on the Platform (include URL)
Your contact information (name, address, phone number, email)
A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
Your physical or electronic signature

Kastkart will process valid notices and remove or disable access to infringing content promptly.

Repeat Infringer Policy:

Kastkart will terminate the accounts of users who are determined to be repeat infringers. A user who receives three valid DMCA takedown notices within any 12-month period may have their account permanently suspended.

Counter-Notification:

If you believe your content was removed in error, you may submit a counter-notification to the designated agent. If a valid counter-notification is received and the copyright owner does not file a lawsuit within 10–14 business days, Kastkart may restore the content at its discretion.
